GENERAL TERMS OF SALE

2. Subject matter

These General Terms govern the distance contracting of the products and services offered in the online store www.portaltrendy.com, in accordance with the TRLGDCU, the LSSI-CE and other applicable legislation.

These terms will remain in force for as long as they are accessible on the website. Portal Trendy, S.L. reserves the right to amend them without prior notice; the version in force at the time of contracting will apply.

3. Parties involved

The contracting process takes place between the “Customer” — a consumer natural person who registers and makes a purchase — and Portal Trendy, S.L.

“Customer” shall mean any person who registers by completing the required fields (first name, last name, address, email and password) and makes the corresponding payment.

4. Right of exclusion

Portal Trendy, S.L. reserves the right to deny or withdraw access to the site and/or services, without prior notice, to those users who breach these Terms.

5. Contracting process

To purchase any product, the customer must follow these steps:

  • Select the product and add it to the cart.
  • Review the product information. The prices shown include the applicable VAT.
  • Access the cart and check the order summary.
  • Register or sign in as a registered user.
  • Enter the shipping details and select the payment method.
  • Confirm the order. Once payment is completed, you will receive a confirmation email. If you do not receive it within a few hours, please contact us.

Prices and transparency

Prices include the VAT in force. Portal Trendy, S.L. reserves the right to change them at any time; the price in force at the time the order is placed will apply.

In accordance with Directive (EU) 2019/2161 (Omnibus Directive), transposed into Spanish law, where a reduced price is displayed alongside a struck-through reference price, the latter shall correspond to the lowest price applied during the 30 calendar days prior to the application of the reduction.

Accepted means of payment

  • PayPal: online payment service. The charge will be made in accordance with the conditions agreed with PayPal.
  • Bank transfer: the customer has 5 business days to make it. Proof of payment must be sent to info@portaltrendy.com. If no confirmation is received within that period, the order will be cancelled.
  • Credit card / Virtual POS: secure payment via a certified gateway.
  • Bizum: instant payment through the mobile banking app.
  • Cash payment (if applicable): the customer pays the amount when collecting the order at the premises.

Delivery times

Once payment is verified, the goods will be delivered within a maximum period of [ X business hours / days ] counted from the day following verification. Orders placed on Saturdays, Sundays or public holidays will be processed on the next business day.

Portal Trendy, S.L. does not act as a commercial intermediary agent; orders are shipped directly from its premises.

6. Intellectual and industrial property

José Manuel Noguera, on his own behalf or as assignee, holds all intellectual and industrial property rights to the website and the elements contained therein. The reproduction, distribution and public communication of the content for commercial purposes without prior authorisation are expressly prohibited. The customer undertakes to respect these rights.

7. Right of withdrawal

In accordance with Articles 102 et seq. of the TRLGDCU, the customer may exercise the right of withdrawal within a maximum period of fourteen (14) calendar days from receipt of the order.

To exercise this right, the customer must notify it before the deadline expires, unequivocally, by:

The product must be returned in its original packaging, unopened and unused. Return costs will be borne by the customer, unless otherwise agreed.

In accordance with Article 103 of the TRLGDCU, the right of withdrawal does not apply to: customised products, products that may deteriorate or expire quickly, or products that by their nature cannot be returned.

The refund will be made within a maximum period of fourteen (14) calendar days from the date Portal Trendy, S.L. receives the returned product, using the same means of payment used for the purchase.

8. Out-of-stock products

Portal Trendy, S.L. will have a maximum period of 30 days to supply products not available in stock. If this is not possible, the customer may opt for an equivalent product or a full refund of the amount paid.

On receiving the order, the customer must check its condition in the presence of the carrier, noting on the delivery note any anomaly detected.

9. Exemption from liability

José Manuel Noguera cannot guarantee the technical continuity of the website or the absence of interruptions due to causes beyond his control (force majeure, third-party failures, cyberattacks, etc.).

10. Processing of personal data

The data provided during the contracting process will be processed by José Manuel Noguera in accordance with the Privacy Policy of this website, to which express reference is made.

11. Online dispute resolution

In accordance with Regulation (EU) 524/2013, consumers may use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/.

Likewise, the parties may resort to the available consumer mediation and arbitration systems to resolve disputes out of court.

12. Grounds for termination of the contract

The following shall be grounds for termination of the contract attributable to the customer:

  • The falsity, in whole or in part, of the data provided during contracting.
  • Breach of these General Terms.
  • Abuse of the support services beyond what is contractually established.
  • Any conduct involving improper use of the technology or services of Portal Trendy, S.L.

Termination of the contract entails the immediate loss of rights over the contracted service.

13. Applicable law and jurisdiction

The relationship between Portal Trendy, S.L. and the CUSTOMER shall be governed by the Spanish legislation in force. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the city of Murcia, unless otherwise p
